Terms of Service

Mailbird is an early-stage product — these policies will evolve. Last updated April 2026.

1. Agreement

By creating an account or using Mailbird ("the Service"), you agree to these Terms of Service ("Terms"). The Service is provided by Mailbird ("we," "us"). If you do not agree, do not use the Service.

2. Account registration

You must provide an accurate email address and keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us at support@mailbird.io if you believe your account has been compromised.

You must be at least 16 years old to use Mailbird.

3. Acceptable use

Your use of the Service is governed by our Acceptable Use Policy. Violations may result in suspension or termination.

4. Subscription and billing

Paid subscriptions are billed monthly via our payment processor, Polar.sh. By subscribing you authorize Polar.sh to charge your payment method on a recurring basis until you cancel.

Pricing is published at mailbird.io/#pricing and may change with at least 30 days' notice to active subscribers.

You are separately responsible for any costs charged by your VPS provider; Mailbird does not pay for, host, or have a contractual relationship with your VPS.

5. Trial

New accounts may receive a 14-day free trial. The trial does not require a payment method. Mailbird may end or modify trial terms at any time.

6. Cancellation and refunds

You may cancel your subscription at any time through the Polar.sh customer portal. Cancellation takes effect at the end of the current billing period.

We do not provide prorated refunds for partial months. Refunds are at our discretion and granted in cases of clear service failure on our part.

7. Service availability

We strive for high availability of the management dashboard and API but do not guarantee uninterrupted service. Mail delivery from your VPS continues to function during dashboard outages — your VPS runs a mail server locally and is not dependent on us being online.

We may modify, suspend, or discontinue features with reasonable notice.

8. Intellectual property

The Service, including the dashboard interface, branding, documentation, and source code, is owned by Mailbird and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain all rights to the content of the email messages you send. Your VPS, your DNS records, and your domains are entirely yours.

9. Limitation of liability

To the maximum extent permitted by law, Mailbird's total liability arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

The Service is provided "as is" without warranties of any kind, express or implied, except those that cannot be disclaimed under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Mailbird from claims arising out of your use of the Service, your violation of these Terms or the AUP, or your violation of applicable law or third-party rights — including claims arising from email content sent through your VPS.

11. Governing law

These Terms are governed by the laws of the European Union and the country in which Mailbird's operator is located. Any disputes arising under these Terms will be resolved in that jurisdiction.

If you are a consumer in the EU, the mandatory consumer-protection laws of your country of residence also apply.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email and take effect 30 days after notice. Continued use of the Service after that period constitutes acceptance of the updated Terms.
